TERMS OF SERVICE
These Terms of Service constitute a legally binding agreement between you and WAZender.id governing your use of our WhatsApp API platform. Please read them carefully before accessing the service. By using WAZender.id, you acknowledge that you have read, understood, and agree to be bound by these terms.

ACCEPTANCE OF TERMS
By creating an account or making any API request to WAZender.id endpoints, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our service.

SERVICE DESCRIPTION
WAZender.id provides a developer-facing REST API and webhook infrastructure for sending and receiving WhatsApp messages, managing sessions, and integrating WhatsApp functionality into applications. The service is provided on an 'as-is' basis without guarantees of uninterrupted availability.

ACCEPTABLE USE
You agree not to use the service to send unsolicited commercial messages (spam), phishing attempts, malware, or content that violates WhatsApp's Terms of Service or applicable law. Bulk messaging must comply with rate limits and include opt-out mechanisms. Violations result in immediate account suspension without refund.

ACCOUNT RESPONSIBILITIES
You are responsible for safeguarding your API credentials and for all activity conducted under your account. Notify us immediately at security@wazender.id of any unauthorized use. You must be at least 18 years old and have legal authority to bind yourself or your organization to these terms.

PRICING & PAYMENT
Subscription plans are billed monthly in advance via Stripe. The Developer Core plan is USD $3/month with a 3-day free trial. No refunds are issued for partial billing periods. All prices are exclusive of applicable taxes, which are added at checkout where required by law.

RATE LIMITS & FAIR USE
While we do not impose daily message caps, individual requests are rate-limited to 50 requests/second per API key to protect infrastructure stability. Sessions exceeding reasonable use patterns (defined as 100,000+ messages/day sustained) may be contacted to discuss enterprise arrangements.

INTELLECTUAL PROPERTY
All software, documentation, trademarks, and service marks associated with WAZender.id remain our exclusive property. You retain full ownership of all content and data you transmit via the service. We claim no rights to your message content or business data.

SERVICE LEVEL AGREEMENT
We target 99.9% monthly uptime for API endpoints. Downtime is calculated based on server-side monitoring and excludes scheduled maintenance (announced 48 hours in advance) and issues caused by upstream WhatsApp infrastructure beyond our control.

LIMITATION OF LIABILITY
To the maximum extent permitted by law, WAZender.id shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability for any claim shall not exceed the amount you paid in the 3 months preceding the claim.

TERMINATION
Either party may terminate this agreement at any time. Upon termination, all API access is revoked immediately, and your data is deleted within 30 days. We may suspend or terminate accounts that violate these terms without prior notice.

GOVERNING LAW
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of London, United Kingdom. EU consumer rights under Directive 2011/83/EU remain unaffected where applicable.
